TERMS OF SERVICE

1. Introduction

Welcome to Gallery Talks (trading name of Julie Trinkler Burt, “we,” “us,” or “our”). These Terms of Service ("Terms") govern your (the “Participant”, “you,” or “your”) use of our online booking system, accessible via www.gallerytalks.co.uk, and the purchase of any services or digital products made through this website. By placing a booking or order with us, you agree to be bound by these Terms.

2. Booking and Payment

All orders placed through our website are subject to acceptance and availability. We reserve the right to refuse or cancel any booking at our discretion, including in cases of pricing errors, availability, or suspected misuse.

Once your booking is placed, you will receive an order confirmation email. The contract between you and us is formed when you receive this confirmation.

Payment for talks and visits in the UK must be made in full at the time of placing your booking. We use Squarespace Payments as our online payment solution. We accept payment by major Credit and Debit Cards (such as Visa, Mastercard, American Express (AMEX), and Discover) and Digital Wallets (such as Apple Pay).

We also accept payment via BACS payment and will provide our banking details upon request.

All prices listed on our Fees page are in GBP (£) and inclusive of applicable UK VAT, where relevant. Prices are subject to change without notice.

A deposit of £150 is required in order to secure a place in a group for our trips abroad. The balance is due 100 days in advance of a trip abroad.

In the case of your cancellation of a talk or visit within the UK, we will offer a credit or refund on the condition that a minimum of 48 hours’ notice is given. A full credit or refund will be offered in the case of cancellation by Gallery Talks. 

3. Tour & Trip Information and Itinerary:

We accept responsibility for the accurate description of services on our website and in our email communication regarding destinations, duration, content and itinerary outlines.

We reserve the right to make changes to an itinerary or tour content within reason and without notice should circumstances require.

Our tours fees include guided art talks and the cost of entry into the tour venue but exclude all transportation, accommodation and meals.

4. Conduct:

Participants are expected to behave responsibly, to adhere to the rules of the venue within which our tour is being given and to show due consideration to other tour participants and visitors to the tour venue.

Participants are liable for any damage caused by them to property or costs incurred as a result of their behaviour while participating in our tours.

Unaccompanied children are not permitted to join our tour groups.

We reserve the right to remove a participant from a group and to refuse future participation in our tours in the case of violating conduct guidelines. 

5. Changes and Cancellations:

We reserve the right to make changes to an itinerary or cancel a talk, visit or trip in the case of unforeseeable, unusual and unavoidable circumstances which we could not anticipate even after exercising all due care.

In the case of a cancellation of a talk or visit within the UK made by a participant, we offer a credit or refund on the condition that a minimum of 48 hours’ notice is given. Cancellation must be given in writing by email, WhatsApp or SMS. A credit or refund will be offered in the case of a cancellation by us.

In the case of cancellation of a trip abroad by a Participant with more than 100 days’ notice, after the deposit has been paid but before the balance has been paid, a full refund will be offered. In the case of a cancellation by a Participant with less than 100 days’ notice, the fee is non-refundable

6. Insurance:

Participants are responsible for arranging their own insurance cover in connection with our tours and trips. We strongly recommend that participants in our trips abroad purchase suitable travel (including medical cover) insurance to cover the trip.

If we are obliged to cancel a tour, all fees will be returned to participants except under circumstances related to war, riots, strikes, terrorist activities, natural disasters or other circumstances amounting to forces and/or acts of God. In such cases, we will return monies paid by participants that have not been committed irrecoverably to the tour or trip. 

7. Liability and Disclaimers:

In all circumstances, to the extent that it may be limited as not being excluded from limitation of liability by applicable law, our liability, whether for breach of contract, tort (including negligence) or statutory duty shall be limited to the amount paid by the other party for our tour or trip in question.

We exclude all liability for any claim arising from the behaviour, conduct or negligence of Participants or any third party unconnected with us.

We offer all services 'as is' and makes no warranties, express or implied, regarding the content, duration and other matters related to our tours and trips.

Participants agree to indemnify us for any costs, claims, expenses or damages claimed against us arising from the behaviour or actions of Participants, including but not limited to, damage caused by them to property at any tour or talk venue. 

8. Complaints and Dispute Resolution:

We will use reasonable endeavours to address and resolve any complaints regarding the services provided. Complaints should be made at the time to Julie Trinkler Burt and in writing to the email address below within 10 working days of the completion of the talk, visit or trip abroad.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. 

9. Privacy

Your privacy is important to us. We collect and process personal data, such as your name, email address, and phone number, solely for the purpose of processing and managing your bookings and orders, in accordance with our Privacy Policy. By using this website and booking an art history tour, or placing an order for a digital talk, you agree to the terms set out in our Privacy Policy.

10. Intellectual Property

All content on this website, including images, product designs, and written material, is the property of Gallery Talks and may not be used, reproduced, or distributed without our written permission.

Julie Trinkler Burt asserts the right to be identified as the author of any written materials provided to Participants, including any notes distributed subsequent to a talk, and retains full copyright ownership of such materials and may not be copied, reproduced or distributed without Julie Trinkler Burt’s express written permission.

11. Corrections

There may be information on the Services that contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website. Customers are encouraged to review these Terms periodically.
